IAXAI Privacy Policy

This Privacy Policy describes how information and user data is collected when using the IAXAI website, application or any related products, services, websites, functions or functionalities, and how IAXAI, including its subsidiaries/affiliates they use, shares and manages your information and data. By using any Service, you consent to the collection, use, processing and sharing of your information as described in this Privacy Policy.

1. IAXAI privacy policy

We want to recognize and respect your privacy rights by informing you and by processing and protecting your personal data in accordance with applicable law.

2. Information we collect from you

(a) Account details that you provide to us directly and voluntarily

We may collect and process some or all of the information you provide to us if you express a desire to participate in the project, download or use the Services. These data are: name and surname, email address, postal address, phone number, website and social profile pages, other information provided by you and needed to build a profile, other information you submitted for publication on IAXAI.com.

We use the information you send us to create an Artist Profile that may be visible to other users of the Services.

From the information provided, we will create and publish events in the public „Exhibitions & Events” section and articles in the public „Artists” Blog section.This data may be collected and used by us, other users of the Services and the general public. We strongly recommend that you do not post any information through the Services that allows strangers to identify or locate you or that you do not otherwise wish to share publicly.

(b) Usage data that can be collected automatically

In addition to the information you provide to us, the Services may collect and process additional data automatically. This data may include: Registration data of the device you are using (e.g. IP address, operating system and browser type); Device settings (for example, language preferences); Information on how you use the services (for example, how many times you use the services per day); Requested and referring URLs; Location data collected through your device.

3. How we use your data

(a) To improve services, provide support and communicate with you

We and our service providers may use the data you provide or that is collected through the Services to support and improve the Services, our other sites, applications, products and services. If you are an IAXAI Community Member or cooperate with IAXAI, we will use your contact details to provide you with important information and notifications related to the Services. We will also use them to communicate with you regarding marketing promotions and activities related to promoting your artistic image and your works.

(b) For advertising purposes and as third party content and links

Our Services may be supported by advertising. For this purpose, we can work with various types of advertisers to provide advertising through the Services. We may provide these advertisers with the opportunity to collect data regarding how you use the Services. This data may include information that helps in analyzing and displaying targeted advertisements outside of the Services elsewhere (e.g. on third-party websites and applications). In addition, the Services may contain third-party content and links to third-party websites. To provide targeted electronic advertising to an individual user, advertisers and third parties may use cookies and other media to track online user activities over time and on various websites or platforms.

If you access the Services via a browser, you can customize your browser settings. You can change your privacy preferences at any time. You can set your browser to accept all cookies, block certain cookies, require consent before placing the cookie in the browser, or block all cookies. Please note that blocking files may prevent you from using some of the features offered through the Services.

(c) Analytical services

In order to understand how users use our Services, we may also work with external analytical companies. In this regard, information includes data collection, reporting, measuring the effectiveness of advertisements, and web analytics issues. The purpose of these activities is to collect information on how to use our Services. External analytical services may collect, among others, the following information: displayed content, information about the system used as well as geographical information. You can use a third-party payment service to make a payment through the Services. External payment services (e.g. PayPal) collect information to process your payments. This information is not available to us, unless you have provided us with this information in connection with the use of the Services. Information collected from you by these external payment services is subject to the privacy policy of this external payment service. Before submitting any information to the appropriate third-party payment service, please read the privacy policy that applies there.

We use email to communicate and transfer information. If you’re an IAXAI Community Member, you can also customize your email settings by logging into your account and adjusting your account settings.

If you want to opt-out of receiving emails from us, please follow the instructions in each email you receive from us about how you can opt-out of receiving further marketing messages from us. You can also inform us about your desire to opt out by sending an email to art[at]iaxai.com.

(e) Social media and sharing

In order to promote artists and their art, the Services may use portals, websites, social media, their applications or other external services. They can also use the „sharing function”. They may also contain links to external portals, websites, social media, applications or services, which we may also allow to use information and data to access the functions of our Services. Using these features may result in the collection or sharing of information by third parties.

These media and services are neither our property nor controlled by us. We have no control and we assume no liability for any sharing functionality or content, privacy policy or practices of third party media and services. Where applicable, you are subject to the rules of these third parties.

We encourage you to read the privacy policy and settings of the media or services you work with. There you will learn which information can be collected, used and shared by these media and services.

4. How we share data and information

We may share data and information that you provide or that we collect in certain circumstances, as follows:

(a) Cooperation with advertisers

We may share your information with advertisers, external ad networks and analytics companies. They may use it to provide targeted advertising on the Services or websites or for external advertisement.

(b) Activities through organizations associated with IAXAI

We may share your information with organizations affiliated with IAXAI for the following purposes: (1) providing shared content and services (such as registration, transactions and customer service); (2) improve your experience with the Services, products and other services.

(c) Activity through our service providers

We may share your data with our service providers who work on our behalf and who will only have access to the information necessary to perform these limited functions on our behalf. For example, these providers can be organizations dealing with payment processing, data management, administration of functions, distribution of emails, market research, analysis of marketing information, management of promotions, collection or aggregation of customer data.

(d) As required by law or for the protection of  rights and compliance with our policies

To the extent permitted by law, we will disclose your information to government authorities or third parties, including national security or law enforcement authorities, if required by law or upon request in response to a subpoena or court order. Please be aware that upon disclosure to any third party your information may be available to others to the extent permitted or required by applicable law.

(e) Legal changes in ownership

In the event of a merger, acquisition or other type of sale of all or part of our assets or any activity, any user information owned or controlled by us may be one of the assets transferred to third parties as part of such a transaction or event. Please note that any information you provide or that may be collected may be subject to a new privacy policy adopted by the successor or buyer, respectively.

5. Your access and control of your information – accessing, correcting or deleting information

When requesting access to your personal data, enter the information you provided through the Services. To verify your identity or to confirm that you have the appropriate email account, we may ask you for additional information.

If you want us to remove the information you provided through the Services, please contact us at art[at]iaxai.com. We will perform data deletion within a reasonable period of time. Please note that some or all of the information you provide may be required for the Services to function properly – and in case of deletion you may lose access to them. It should also be remembered that some information may be automatically stored in the backup memory or in the archive memory.

Upon request, we will provide you with an electronic file containing basic account information and information under your sole control.

6. Security measures

We provide standard physical, electronic and procedural safeguards to protect personal data processed and stored by us. We limit access to this data to authorized employees and contractors who must know this information in order to operate, develop or improve our Services.

Please note that while we strive to ensure reasonable data security, no security system can prevent any potential security breaches. Therefore, we cannot guarantee the security of any information transmitted as part of or through the Services, and you do proceed at your own risk.

7. Children’s privacy

The services are not intended for children under 18 years of age. We do not knowingly collect, distribute or disclose personal information about children under the age of 18. If a parent or guardian finds out that his/her child has given us information without their consent, he,she should immediately contact us at art[at]iaxai.com.

8. Updates of this Privacy Policy

We can make changes to the privacy policy. In case we do, we will notify you of any changes at least thirty (30) days before the date the changes entry into force. If you do not agree to these changes after such notification, you should stop using the Services before the modified privacy policy enters into force. Using the Services after the entry into force of the amended privacy policy means that you have agreed to the changes and you will be bound by the changed privacy policy.
